This agreement (hereby referred to “Agreement”) consists of the terms, conditions and related policies of AlphaState3D Virtual Tours (hereby referred to as “AlphaState3D”)
By signing this Agreement, you hereby consent to the following:

AlphaState3D’s collection and use of your personal information as described in this Agreement
All other provisions mentioned within this Agreement

TERMS AND CONDITIONS

Please note that the material provided by AlphaState3D is not to be used for any other purpose.
By placing an order with AlphaState3D, you consent to the following:

When a property is to be 3D scanned, photographed or filmed, you are responsible for:

Ensuring the property is made available at the scheduled time for our 3D Consultants
Ensure that our 3D Consultants are provided with any and all necessary rights and access required to the property that will digitally captured
Ensuring the property is photo ready and clean (NOTE: If the property is not ready to be digitally captured, AlphaState3D may choose to cancel the booked appointment and/or reschedule same)

If the 3D Consultant arrives at the property and it is untidy, the 3D Consultant will capture the property as described in the Booking Form. It is your responsibility for ensuring that the property is capture ready
If the client is not pleased with the digital content captured as a result of the property not being ready for the booked appointment, and would like to have the property reshot, then reshoot fees will apply, as well as any other additional charges required for same (i.e., travel costs)
Further to (3), in the event the digital content captured does not meet our standards of quality and professionalism, we will reshoot the property at no charge to you. If, however, you request additional digital content for seasonal changes, night shoots, or additional imagery for any reason, then additional fees will apply
Copyright of the digital content captured, virtual tour, text descriptions and brochures belong solely to AlphaState3D
AlphaState3D has the right to: distribute copies of the work completed, produce “derivative” work and publicly display copies of the work completed

LIMITATION OF LIABILITY

Neither AlphaState3D nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties
Independently contracted representatives provide some or all services. Neither AlphaState3D nor its independently contracted service distributors is liable for any negligence, damages, or any wrongdoing on the part of the independent service representatives.
Neither AlphaState3D nor its independently contracted distributors is responsible for damages, delays or failures in performance resulting from acts or occurrences beyond our reasonable control such as acts of God, weather, or other uncontrollable conditions that prohibit services from being rendered as promised. (Hurricanes, Tornadoes, Earthquakes, Acts of Terrorism, etc.)
AlphaState3D is permitted to enter the property/location in question, as directed, for the purposes of digitally capturing the required content. In doing so, unless solely at the fault of AlphaState3D, any damage/destruction to the property or its related contents, is the responsibility of the property owner.

PAYMENT AND PRICING

All projects rendered by AlphaState3D are subject to a 50% deposit of the final price pertaining to the approved-upon work. Please note this deposit is non-refundable
All published prices, rates and packages do not include GST/HST. Prices are subject to change without notice
Any additional fees, add-ons and/or costs associated/incurred to complete the project will be invoiced at project completion and subject to this Agreement
Square Footage Fees are billed at $0.15/sf over 3500sf of TOTAL square footage captured (including basement). For multi-family dwellings that require a separate tour or floorplan, a fee of $80/unit will be applied to cover additional tour costs and floorplans

SUBSCRIPTION AND 3-MONTH TRIAL PERIOD OPTION

Should you wish to do so, you may enroll in a recurring yearly subscription. This will, in effect, keep the tour of the property in question live and active for online usage, and thereby be accessible to the public. The cost associated with this is $84 per annum
The first three (3) months of any tour conducted by AlphaState3D will be of no cost to you. Should you wish to enroll in the services provided by AlphaState3D following this trial period, this is within your discretion
Once a tour is completed, the footage will be archived by AlphaState3D
Should you wish to terminate your enrollment with AlphaState3D after the 3 month trial period, you are permitted to enroll at a later date. In doing so:

The charge associated to re-activate the digital ED tour would be cut in half (i.e.: you would be charged half of what was paid originally)
As above, after a 3-month period, you will be required to decide whether you want to extend the digitally-captured tour, or further, subscribe to a yearly plan

YOUR DIGITAL RIGHTS

If you have purchased the use of a 3D virtual tour, photography, video, PDF floorplan, text and brochures from AlphaState3D with the intention of promoting a property for sale or lease, you are permitted to:

Promote the property in newspapers, magazines and websites
Promote themselves by showcasing the purchased services as part of their marketing plan

DESCRIPTION OF LOCATIONS COVERED

AlphaState3D offers services within a 65km radius of Hamilton, Ontario. This includes: Niagara, St Catharine's, Welland, Pelham, Lincoln, Grimsby, Stoney Creek, Burlington, Oakville, Halton, Peel, Waterloo, Brant, Haldimand
Please note: locations that extend beyond a 65km radius are subject to an extended travel fee rate billed at $0.40/km. Please contact us for further information on areas that are outside our normal coverage area

PROJECT DELIVERY TIMES

Photos and digital tours are delivered within 36 hours of project site visit and completion
Video, drone footage, standard floorplans and virtual staging are delivered within 48 hours of project site visit and completion

CANCELLATION POLICY

All cancellations must be made within a minimum of 48 hours notice
Failing this, a reshoot or not- ready fee may apply
Cancellations made within 24 hours of a scheduled booking are subject to 100% of the booking fee, and any expenses incurred (unless rescheduled to another firm date and time)
If the project is not ready for 3D scanning or photography when the 3D Consultant arrives on location (i.e.: if it is inaccessible, un-safe, un-prepared, cluttered, dirty, excessive damage, under construction, deemed to be in a dangerous condition, or any other reason), the 3D Consultant reserves the right to refuse the photoshoot without penalty and without a refund
In case of inclement weather or illness, both the 3D Consultant and the client may reschedule to any available future slot without penalty, within a 24hr notice
All cancellations/reschedule requests MUST be submitted via email ONLY

SOCIAL MEDIA/ADVERTISING POLICY

AlphaState3D reserves the right to use the digitally-captured content for their marketing and advertising purposes via their website and social media platform (i.e.: Facebook, Instagram, Twitter, YouTube, TikTok, LinkedIn)
